The property known as 'Le Gîte de Brécéhan' (the Gîte) is offered for holiday rental subject to confirmation in writing by Isabelle Birch (the Owner) to the person renting (the Client) in accordance with the following terms and conditions.
1 The Gîte is reserved by contacting the Owner by email or in writing together with payment of the initial non-refundable deposit (30% of the total rent due). Following receipt of the booking form and deposit, the Owners will return a confirmation providing formal acceptance of the booking.
2 The Owner reserve the right to refuse any booking without an explanation. In the event of this happening the Client will be advised in writing of any such refusal and all payment will be refunded to the Client.
3 The Client is strongly advised to arrange a comprehensive travel insurance policy (including cancellation cover) and to have full cover for the party's personal belongings, public liability, etc., since this is not covered by the Owner's insurance.
4 The balance of the rental, plus the security deposit (see clause 6) is payable not less than eight weeks before the start of the rental period. If the balance is not received by the due date, the Owner reserve the right to give written notice that the reservation is cancelled. The Client will remain liable to pay the balance of the rent unless the owners are able to re-let the property.
5 Reservations made within eight weeks of the start of the rental period require full payment at the time of booking.
6 A separate security deposit of £100 is required in case of, for example, damage to the property or its contents. However the sum reserved by this clause shall not limit the Client's liability to the Owner. The Owners will account to the Client for the security deposit and will refund the balance due within two weeks of the end of the rental period.
7 Dishonoured cheques will automatically cancel any reservation made, and the Owners will advise the Client accordingly.
8 The rental period shall commence at 4.00pm on the first day and finish at 10.00am on the last day. The Owner will not be obliged to offer the accommodation before the time stated and the Client will not be entitled to remain in occupation after the time stated.
9 The maximum number of people (including children) occupying the gite must not exceed eight plus a baby of less than 2 years unless permission has been granted by the Owners in writing. If any Client is exceeding these numbers in the property or on the Owner land, a surcharge will apply on a pro-rata basis.
10 The Owner will provide bedding, bed linen and tea towels. Personal hand and bath towels are not included as standard, but can be provided for €5 per person (to cover the additional laundry costs).
11 The Owner operate a no smoking policy inside the property for the comfort of future guests. Any Client disregarding this condition will forfeit their security deposit.
12 A single pet only is permitted at the property. The pet is not permitted in the upstairs areas or other bedrooms.
13 The Client and their party agree to be considerate tenants and take good care of the property and its contents, and leave it in a clean and tidy condition at the end of their stay. A final inspection is included in the rental price together with up to an hour of cleaning. If, in the opinion of the owners (or their local agent), the property is not left clean and tidy and additional cleaning over the hour is required, a payment of €15 an hour (maximum of 4 hours) shall be retained from the security deposit to cover such cleaning costs. The Client also agrees not to act in any way that might cause disturbance to those resident in neighbouring properties.
14 Without delay, the Client shall report to the Owners (or their local agents) any defects to the property or breakdown of equipment or appliances in the property and grounds. The Owners will then be able to make arrangements to repair/rectify the problem at the earliest opportunity.
15 The Owner shall not be liable to the Client:-
- for any temporary defect or stoppage in the supply of public services to the property, nor in respect of any equipment, plant, machinery, or appliance in the property or garden.
- for the loss, damage or injury, which is the result of adverse weather conditions, riot, war, strikes or other matters beyond the control of the Owners.
for the loss, damage or inconvenience caused to or suffered by the Client if the property shall be destroyed or substantially damaged before the start of the rental period and in any such event, the Owners shall within seven days of notification to the Client, refund all sums previously paid in respect of the rental period.
16 Under no circumstances shall the Owners liability exceed the amount paid to the Owner for the rental period.
17 Once the Owner confirm the booking, these booking conditions form part of the contract.
18 This contract shall be governed by English law in every particular.
1 The Pool will normally be open for use from mid June to mid September.
2 It is strongly recommended that the pool is covered when not in use as this will maintain and in sunlight increase the temperature of the water. The cover should be rolled on or off by an adult using the roller provided and should never be left partly on/off.
3 The pool area (area within the security fence) should only be entered by the gate and not by climbing the security fence. The gate should not be left open. Footware should be left at the gate and the bowl provided should be used to wash feet prior to entering the pool area. Only appropriate swim ware shall be used in the pool.
4 Children under the age of 12 are not allowed in the pool area unless under the supervision of a responsible adult.
5 The pool is for the benefit of the occupants of the gite only without the express permission of the owners.
6 No breakables or food or drink may be consumed in the pool area. No hard edged objects should be taken or thrown (including gravel) into the pool area or pool.
7 Guests are requested to avoid swimming with excessive sun tanning products by towelling off excessive cream an reapplying on exit.
8 The maximum water depth is 1.65m and diving is not advised
9 Children who are not fully toilet trained should wear nappy swim ware at all times
10 The owner reserve the right to close the pool for cleaning purposes, to clear filtration blockages or for any other reason they deem necessary.
11 For reasons of health and safety and comfort of all guests using the pool, the Owner reserve the right to request anyone contravening the above conditions to leave the pool area immediately.
